Terms of Use
Custom End User License Agreement for Study Now: JLPT.
1. Acceptance of these Terms
This End User License Agreement ("Agreement") is a legal agreement between you and Kota Ogino ("Developer") governing your use of the Study Now: JLPT application, including any content, features, updates, and subscription services made available through the application ("Licensed Application").
By downloading, installing, accessing, or using the Licensed Application, you agree to be bound by this Agreement. If you do not agree, do not download, install, access, or use the Licensed Application.
2. License Grant
Subject to your compliance with this Agreement, Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where applicable.
3. Ownership
The Licensed Application is licensed, not sold, to you. Developer and its licensors retain all right, title, and interest in and to the Licensed Application, including all intellectual property rights.
4. What the Licensed Application Does
Study Now: JLPT is an educational application designed to support JLPT study and focus habits. The Licensed Application may use Apple Screen Time / FamilyControls features to help restrict apps or websites selected by the user until the user studies using the Licensed Application.
The Licensed Application may offer study tools, progress tracking, streaks, history features, optional rewarded ads, and premium subscription features.
5. Eligibility
The Licensed Application is intended for a general audience. The Licensed Application currently does not require a user account or login.
6. Subscriptions and Billing
The Licensed Application may offer auto-renewable subscriptions, including monthly, 3-month, 6-month, or yearly options.
Payment will be charged to your Apple account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current period.
You may manage or cancel subscriptions in your Apple account settings. If offered, restore purchases functionality may allow you to restore a previously purchased subscription.
Prices may vary by region and may change in the future. Any free trial or promotional offer, if provided, will be governed by the terms presented at the time of offer and may be forfeited when you purchase a subscription where permitted by law.
7. Free Features, Premium Features, and Rewarded Ads
The Licensed Application includes free features and optional premium subscription features. Feature availability, limits, rewarded-ad availability, and premium entitlements may change over time.
Rewarded ads, where offered, are optional and do not create a subscription, extend a billing period, or modify Apple subscription billing terms.
8. Acceptable Use Restrictions
You agree not to:
- copy, modify, distribute, sell, rent, lease, lend, sublicense, or otherwise exploit the Licensed Application except as expressly permitted by this Agreement or applicable law;
- reverse engineer, decompile, disassemble, attempt to derive source code from, or attempt to defeat technical protections in the Licensed Application, except to the extent such restriction is prohibited by applicable law;
- use the Licensed Application unlawfully, fraudulently, abusively, or in a way that interferes with the Licensed Application, Apple services, or other users;
- attempt to bypass premium controls, subscription controls, free-tier limits, or rewarded-ad rules;
- attempt to manipulate the Licensed Application or associated systems to obtain unauthorized rewards, benefits, or access.
9. Privacy
Your use of the Licensed Application is subject to the Privacy Policy:

10. Third-Party Services
The Licensed Application may enable access to third-party services, websites, advertising services, or content. Your use of those third-party services may be subject to separate terms and privacy policies. Developer is not responsible for third-party services or content except as required by applicable law.
11. Maintenance and Support
Developer is solely responsible for providing any maintenance and support services for the Licensed Application, if any. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.
12. Warranty Disclaimer
To the maximum extent permitted by applicable law, the Licensed Application is provided "as is" and "as available," with all faults and without warranty of any kind. Developer disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.
Developer does not warrant that the Licensed Application will be uninterrupted, error-free, secure, available at all times, or suitable for your specific goals, including any examination result or study outcome.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Developer will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business interruption, or other commercial damages or losses arising out of or related to your use of or inability to use the Licensed Application, however caused and under any theory of liability, even if advised of the possibility of such damages.
Nothing in this Agreement limits liability to the extent such limitation is prohibited by applicable law.
14. Product Claims
Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and use of the Licensed Application, including but not limited to:
- product liability claims;
- any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and
- claims arising under consumer protection, privacy, or similar laws.
15. Intellectual Property Claims
In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
16. Legal Compliance and Export
You represent and warrant that:
- you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and
- you are not listed on any U.S. Government list of prohibited or restricted parties.
You may not use, export, or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained.
17. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must stop all use of the Licensed Application and delete all copies in your possession or control.
18. Apple as Third-Party Beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right, and will be deemed to have accepted the right, to enforce this Agreement against you as a third-party beneficiary.
19. Governing Law
If you are a consumer in a jurisdiction with mandatory consumer protections, those protections remain applicable.
Unless otherwise required by applicable law, this Agreement is governed by the laws of Japan, without regard to conflict of law principles.
20. Changes to this Agreement
Developer may update this Agreement from time to time. Continued use of the Licensed Application after an updated version is made available means you accept the updated Agreement.
